1 The designs

Add one entry for each design — each product, or each version of a product, that you want to protect. Name the product with one of KIPO's official product names (search in English or Korean): the name fixes the class, which decides the kind of examination and the official fee.

    Questions about designs in Korea

    How long does it take?
    KIPO usually examines a design application within several months of filing. Products in Locarno classes 1, 2, 3, 5, 9, 11 and 19 (foodstuffs, clothing, bags and personal belongings, textile piece goods, packages and containers, jewellery and adornments, stationery and printed matter) go through partial examination, without a search of earlier designs, and are usually registered faster. Expedited examination is available in some cases, for example when the design is already being used in Korea.
    What does the fee include?
    $300 per application and $150 for each additional design in the same application (designs in the same Locarno class are filed together; a design in another class is a separate application at $300): a formality review of the drawings, filing at KIPO and reporting the filing, plus KIPO's official fees as quoted. There is no drawing fee when you send drawings or a 3D model that can be filed as it is; drawings prepared by us are $150 per design. Priority claim: $50. The registration fee is paid later, when KIPO allows the design.
    Can you prepare the drawings?
    Yes. Send us 3D CAD files (STEP, IGES, STL and the like), photos or sketches, and we prepare drawings that meet KIPO's requirements: line drawings or renderings showing the product alone, from enough angles to show its whole appearance. We send them to you for approval before filing.
    What drawings does KIPO need?
    Drawings or photographs that show the whole appearance of the product, usually a perspective view and the six orthographic views (front, rear, left, right, top and bottom). Views must be consistent with each other and show only the product, on a plain background, without text, dimensions or other objects.
    Can I protect only part of a product?
    Yes, as a partial design. The part you claim is drawn in solid lines and the rest in broken lines (or shown by colour or shading). Tick "partial design" for that design and tell us which part you claim.
    Can several designs go in one application?
    Designs in the same Locarno class can be filed together as one multiple-design application of up to 100 designs: $300 for the application and $150 for each additional design. Designs in different classes are filed as separate applications, each at $300. KIPO's official fees are charged per design either way.
    Can I claim priority?
    Yes, within 6 months of your first filing elsewhere. Please send us the certified copy of the earlier application as early as possible, ideally before we file. It can be filed later if needed, but no later than 3 months after the Korean filing date.
    I have already shown the design publicly. Can I still file?
    Usually yes: Korea has a 12-month grace period for your own disclosure, which we claim for you when filing. Tell us in the notes when and where the design was first shown, and keep evidence of it (for example the catalogue, web page or trade-fair photos).
    Do you need a power of attorney before filing?
    No. We file on your instructions and send you a power of attorney form to sign afterwards.
    Do I need a Korean attorney to file?
    Yes, if you have no address or place of business in Korea. Foreign applicants must act through a representative in Korea — that is the role we take, from filing through registration.
    How long does a Korean design registration last?
    20 years from the filing date. The registration fee for the first 3 years (KRW 25,000 per design and year) is paid on allowance, and annual fees follow from the 4th year.
    Should I file directly or through the Hague system?
    Both work. Filing directly lets us prepare the drawings and the product description to KIPO's requirements from the start, which avoids many of the objections raised against international registrations designating Korea. More on designs in Korea.
