Questions about filing a patent in Korea
- When is the deadline?
- To claim priority, 12 months from the earliest priority date. Without priority there is no fixed deadline, but file before the invention is disclosed — the grace period for prior disclosure is limited.
- Do you need a signed power of attorney before filing?
- No. We file on your instructions and send you a power of attorney form to sign afterwards.
- Can I file in English?
- Yes. A foreign-language application secures the filing date; the Korean translation follows within 1 year 2 months from the priority date (or the filing date).
- When must examination be requested?
- Within 3 years of the Korean filing date. Until then the application stays pending without examination.
- I have already disclosed the invention. Can I still file?
- Usually yes, if you file within 12 months of your own disclosure and claim the grace period in the application. Tell us the date and form of the disclosure when you order.
- Patent or utility model?
- A utility model protects devices with a lower inventive-step threshold and lasts 10 years from filing; a patent lasts 20 years. Utility model or patent in Korea.
- Do I need a Korean attorney?
- Yes, if you have no address or place of business in Korea. Foreign applicants must act through a representative in Korea.
