Questions about the Korean national phase
- When is the deadline?
- 31 months from the earliest priority date. With a translation extension request, the translation can follow by 32 months.
- Do you need a signed power of attorney before filing?
- No. We file on your instructions and send you a power of attorney form to sign afterwards.
- What if the deadline has passed?
- Submit the order anyway and mention it in the notes. Restoration may still be possible; we will contact you the same day.
- Is an English translation enough?
- No. The description, claims and drawing text must be filed in Korean. We prepare the Korean translation from the published PCT application and you can review it before filing. How the Korean translation works.
- When must examination be requested?
- Within 3 years of the international filing date. We can request it at entry or later — requesting it later spreads the cost, requesting it at entry gets an earlier decision.
- Can examination be accelerated?
- Yes. Korea takes part in the Patent Prosecution Highway: with allowable claims from another office, examination is usually much faster. PPH in Korea.
- Do I need a Korean attorney?
- Yes, if you have no address or place of business in Korea. Foreign applicants must act through a representative in Korea.
- How much does the national phase cost?
