Questions about trademarks in Korea
- How long does it take?
- KIPO usually examines a trademark application in about 12 months. With expedited examination (when the mark is used in Korea), a decision can come within a few months.
- What does the fee include?
- $250 for the first class and $120 for each additional class: the free quick check, filing at KIPO and reporting the filing, plus KIPO's official fees as quoted. The registration fee (paid when KIPO allows the mark) is separate.
- What if KIPO raises an objection?
- Amending the goods and services: $100 plus a KRW 4,000 official fee. A written argument against a refusal: $200. Both together: $300 plus KRW 4,000.
- Why choose KIPO standard terms?
- When every item in a class is a KIPO standard term, the official fee for that class drops from KRW 52,000 to KRW 46,000, and KIPO is less likely to ask you to amend the list. Items you type yourself are filed as written. KIPO may object to them, and amending them is charged as above.
- Can I claim priority?
- Yes, within 6 months of your first filing elsewhere. Please send us the certified copy of the earlier application as early as possible, ideally before we file, so that it is filed with the application. It can be filed later if needed, but no later than 3 months after the Korean filing date.
- Do you need a power of attorney before filing?
- No. We file on your instructions and send you a power of attorney form to sign afterwards.
- Do I need a Korean attorney to file?
- Yes, if you have no address or place of business in Korea. Foreign applicants must act through a representative in Korea — that is the role we take, from filing through registration.
- Is Korea first-to-file? Do I need to use the mark first?
- Korea is first-to-file: the earlier application wins, and you do not need to have used the mark in Korea to file or register it. A registered mark that has not been used in Korea for three consecutive years can be cancelled on request by a third party.
- What happens after KIPO accepts the mark?
- KIPO publishes the mark for two months so that others can oppose it. If no opposition succeeds, KIPO decides to register it and the registration fee becomes payable (KRW 201,000 per class for 10 years). We report each step and remind you of the payment deadline.
- How long does a Korean trademark registration last?
- 10 years from the registration date, renewable for further 10-year terms without limit.
- Should I file directly or designate Korea through Madrid?
- Both work. Filing directly lets us draft the goods and services in KIPO standard terms from the start, which avoids the specification objections common in Madrid designations and keeps the official fee at the lower rate. More on trademarks in Korea.
- Can my mark be in English or another language?
- Yes. Latin letters, other scripts and logos can all be registered. If the mark is a word, tell us how it is pronounced in Korean if you know it — the quick check searches that form too, because Korean examiners compare marks by their Korean pronunciation as well.
